  1. THE PROMOTER

  1. THE PRIZE DRAW
    • The title of the competition is Win a Dream Getaway in the Lake District with Wheelchair Accessible Vehicle Rental Included.
    • The competition is a prize draw.

 

 

  1. THE PRIZE
    • The prize is a three-night weekend stay (arriving on a Friday) or four-night midweek stay (arriving on a Monday) for up to 7 people staying at Rose Cottage, Hackthorpe, Cumbria.
    • This self-catering stay (meals and drinks are not included) can be taken between 1 October 2024 and 30 April 2025, excluding the period from 16 December 2024 to 10 February 2025. Please note that all bookings are subject to availability.
    • The winner must provide a minimum of 14 days advance notice for the accommodation booking to the Provider, Lakes For All.
    • The check in time for Rose Cottage is 3pm and check out time is 10am.
    • The winner is subject to Lakes for All usual Booking Terms and Conditions, excluding 2. Payment.
    • Condition 3. of Lakes for All Booking Terms and Conditions will apply to the prize winner. A deposit amounting to £300 will be taken at the time of booking as a damages and cautionary security deposit.  This will be held until 48 hours after departure when the property has been inspected.
    • The prize entitles the winner to WAV hire for the duration of their stay and is redeemable by contacting the Open Road Access team.
      • Delivery, collection, insurance and breakdown cover are included.
      • Your vehicle reservation must be made 14 days prior to the hire start date and is subject to availability.
      • Your hire is subject to driver eligibility requirements which will be provided at the time of booking.
      • Your hire is subject to our usual Terms and Conditions of hire and are in addition to the terms and conditions of this offer.
      • In the event of any conflict or discrepancy between these terms and our Terms and Conditions, our Terms and Conditions shall take precedence.
      • Customers must be aged 18 years or over to drive an Open Road Access vehicle.
    • The prize is not negotiable or transferable.
    • The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so. The prize of the stay at Rose Cottage is supplied by Lakes For All, 39 Salkeld Road, Penrith, Cumbria, CA11 8BP. The prize is subject to the Supplier’s usual terms and conditions, which can be found at: https://lakesforall.co.uk/terms-and-conditions-of-booking/.  The wheelchair accessible vehicle rental is supplied by Open Road Access, Park House, Chantry Court, Sovereign Way Chester, CH1 4QN and is subject to the Supplier’s usual terms and conditions of hire.
    • You will receive an email informing you that you have won. In order to claim the prize, you must reply within 5 days of notification, stating you are accepting the prize, otherwise the prize will be redrawn and offered to the next entrant selected at random.
    • The Promoter does not accept any responsibility if you are not able to take up the prize.

 

  1. HOW TO ENTER
    • The competition will run to 23:59 on 02/08/2024 (the ‘Closing Date’) inclusive.
    • All competition entries must be received by the Promoter by no later than the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
    • No purchase necessary. Enter online by completing the entry form at (insert url) by the Closing Date.
    • The competition requires that all entrants provide the following information at the point of entry: First name and last name of person completing the entry, email address of person completing the entry, phone number of person completing the entry, acceptance of the terms and conditions.
    • The Promoter will not accept responsibility for competition entries that are lost or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. All internet connection charges and any other expenses which may be incurred due to entering or winning the competition are the sole responsibility of the participant.
    • By submitting a competition entry, you are agreeing to be bound by these Terms and Conditions.

  1. ELIGIBILITY
    • The competition is only open to residents in the United Kingdom, excluding NI, aged 18 years or over, except employees (and members of their immediate families/households) of the Promoter, its affiliated companies, their agencies and anyone professionally connected with this competition.
    • In entering the prize draw, you confirm that you are eligible to do so and eligible to claim the prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
    • The Promoter will not accept competition entries that are: automatically generated by computer; completed by third parties or in bulk.
    • There is a limit of one entry to the competition per email address on the Promoter’s website. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
    • The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition and to verify all entries including but not limited to asking for address and identity details (which must be provided within 3 working days). The Promoter may refuse to award a prize or withdraw prize entitlement, refuse further participation in the competition and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this competition’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the competition or won using fraudulent means.
    • The Open Road Access vehicle rental is subject to driver eligibility requirements which will be provided at the time of booking.
    • The Open Road Access vehicle rental is subject to our usual Terms and Conditions of hire and are in addition to the terms and conditions of this promotion.
    • In the event of any conflict or discrepancy between these terms and our Terms and Conditions, our Terms and Conditions shall take precedence.
    • Customers must be aged 18 years or over to rent an Open Road Access vehicle.

 

  1. WINNER ANNOUNCEMENT
    • The decision of the Promoter is final, and no correspondence or discussion will be entered into.
    • The winner will be drawn from valid entries using randomised software and announced via the Open Road Access e-newsletter and social media channels within 14 days of the Closing Date. If the winner does not claim the prize, within 5 working days of notification the winner’s claim will become invalid and the Promoter reserves the right at its absolute discretion to withdraw prize entitlement and award the prize to a substitute winner drawn at the same time as the original, following which the Promoter reserves the right at its absolute discretion to withdraw the prize.
    • The Promoter will either publish or make available information that indicates that a valid award took place.

 

  1. LIMITATION OF LIABILITY
    • Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.
    • Your statutory rights are not affected.

 

  1. INTELLECTUAL PROPERTY RIGHTS
    • The Promoter does not claim any rights of ownership in your competition entry.

 

 

  1. DATA PROTECTION AND PUBLICITY
    • If you are the winner of the competition, you agree that the Promoter and the Supplier may use your name and image to announce the winner of this competition and for any other reasonable and related promotional purposes.
    • You further agree to participate in any reasonable publicity required by the Promoter and Supplier.
    • Information regarding personal data, which is provided by you when you submit your entry, will be processed in a database for the purpose of managing this competition.
    • By entering this competition you agree to receive marketing messages from Open Road Access. You may opt out at any time.
    • Your personal details will at all times be kept confidential and in accordance with the UK GDPR and Data Protection Act 2018. By participating in the competition, you agree to the use of your personal data as described here by the Promoter or its agents and suppliers. You can withdraw your consent at any time, but will no longer be able to participate.

 

    1. GENERAL
      • The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
      • These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
